In December 2008 the 5th Circuit ordered Nanon Williams case to be sent back to federal court to Judge Nancy Atlas for a full de novo evidentiary hearing. It will be treated like she is the first person to see the claim and doesn't have to show deference to state courts, which is what she did when she ruled against Nanon earlier. She gave deference to the CCA. So apparently this de novo hearing is like starting at the beginning without having to give any weight to what previous courts have said.
Nanons lawyer Morris Moon will be allowed to put on everything they have re: ineffective assistance of counsel. The hearing will take place in April 2010. Nanon supporters say that there is a high chance that this hearing will finally set Nanon free.===>
